1. Agreement to Terms

By accessing or using the Reputation X website (the “Site”) or any services, tools, or resources provided by Reputation X, a division of Obtainium Ventures LLC (“Reputation X,” “we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use the Site or our services.

These Terms constitute a legally binding agreement between you (“you” or “Client”) and Reputation X. We reserve the right to update these Terms at any time. Continued use of the Site or our services after any changes constitutes acceptance of the revised Terms.

2. Services Overview

Reputation X provides online reputation management services, including but not limited to:

  • Search result suppression and optimization
  • Content removal assistance
  • Wikipedia article creation and editing
  • Knowledge Panel management
  • Review management
  • Reputation strategy consulting
  • Generative engine optimization (GEO)
  • Free online tools and educational resources

The specific scope, deliverables, and terms of any paid engagement are defined in a separate Statement of Work (“SOW”) or service agreement executed between you and Reputation X. In the event of a conflict between these Terms and a signed SOW, the SOW shall control.

3. Eligibility

You must be at least 18 years of age and have the legal authority to enter into a binding agreement to use our services. By engaging with Reputation X, you represent that all information you provide is accurate and complete.

4. Client Responsibilities

When engaging Reputation X for paid services, you agree to:

  • Provide accurate, truthful, and complete information as requested
  • Respond to communications in a timely manner to avoid project delays
  • Refrain from misrepresenting your identity, credentials, or achievements
  • Not request that Reputation X publish false, misleading, or defamatory content on your behalf
  • Comply with all applicable laws and regulations
  • Not use our services for any illegal, fraudulent, or unethical purpose

Reputation X reserves the right to decline or terminate any engagement where, in our sole discretion, the requested work would be unethical, misleading, or in violation of applicable laws or platform policies.

5. No Guaranteed Outcomes

Online reputation management involves search engines, third-party platforms, and editorial processes that are outside the direct control of Reputation X. While we apply proven methodologies and best practices developed over nearly two decades of experience, we do not and cannot guarantee specific outcomes, including but not limited to:

  • Specific search engine rankings or positions
  • The removal of any specific piece of content
  • Approval or publication of Wikipedia articles or edits
  • Changes to Google Knowledge Panels
  • Specific review ratings or volumes
  • Specific timelines for achieving results

Any projections, estimates, or examples of past results shared during the sales process or on this Site are provided for informational purposes only and do not constitute a guarantee of future performance. Each engagement is unique, and results depend on a variety of factors including, but not limited to, the nature of existing content, search engine algorithms, and platform policies.

6. Fees and Payment

Fees for services are set forth in the applicable SOW or service agreement. Unless otherwise specified:

  • Fees are due in accordance with the payment schedule outlined in your SOW
  • All fees are quoted in U.S. dollars
  • Late payments may be subject to a late fee of 1.5% per month or the maximum rate permitted by law, whichever is less
  • Reputation X reserves the right to suspend work on any account with an outstanding balance exceeding 30 days past due

Free tools and resources available on the Site are provided at no charge, but Reputation X reserves the right to modify, limit, or discontinue any free offering at any time without notice.

7. Intellectual Property

All content, materials, tools, software, designs, trademarks, and other intellectual property on the Site are owned by or licensed to Reputation X and are protected by applicable intellectual property laws.

You may not copy, reproduce, modify, distribute, or create derivative works of any content on the Site without our prior written consent. The use of automated tools, bots, or scrapers to access or collect data from the Site is strictly prohibited.

Content created by Reputation X on your behalf during a paid engagement (such as articles, web properties, or other published materials) is subject to the intellectual property terms in your SOW. Unless otherwise agreed in writing, Reputation X retains ownership of proprietary strategies, processes, and methodologies used in the delivery of services.

8. Confidentiality

Reputation X treats all client information as confidential. We will not disclose your identity as a client or the details of your engagement to any third party without your written consent, except as required by law or as necessary to perform the agreed-upon services.

You likewise agree to keep confidential any proprietary strategies, techniques, or materials shared by Reputation X during the course of your engagement.

9. Use of Free Tools

Reputation X offers free tools and resources on the Site, including the RepuScore Checker and SERP Simulator. By using these tools, you agree to:

  • Use the tools for personal or legitimate business purposes only
  • Not attempt to reverse-engineer, modify, or exploit the tools
  • Not use the tools to conduct competitive intelligence or scrape data in an automated fashion
  • Accept that tool results are informational only and do not constitute professional advice

10. Third-Party Platforms

Our services involve interactions with third-party platforms including, but not limited to, Google, Wikipedia, Yelp, Glassdoor, Trustpilot, ChatGPT, and various social media platforms. Reputation X is not affiliated with, endorsed by, or sponsored by any of these platforms.

We comply with the published terms, guidelines, and editorial policies of all third-party platforms. However, these platforms may change their policies at any time, which may affect the scope or outcome of our services. Reputation X is not liable for actions taken by third-party platforms.

11. Wikipedia Services Disclaimer

Wikipedia is an independently governed encyclopedia maintained by volunteer editors and governed by the Wikimedia Foundation. Reputation X is not affiliated with the Wikimedia Foundation or Wikipedia.

Our Wikipedia services are performed in compliance with Wikipedia’s published policies, including guidelines on conflict of interest disclosure. We cannot guarantee that any proposed article or edit will be approved or remain published, as editorial decisions are made by independent Wikipedia editors and administrators.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, REPUTATION X, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR OUR SERVICES.

IN NO EVENT SHALL REPUTATION X’S TOTAL LIABILITY TO YOU EXCEED THE TOTAL AMOUNT OF FEES PAID BY YOU TO REPUTATION X DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the fullest extent permitted by law.

13. Indemnification

You agree to indemnify, defend, and hold harmless Reputation X, Obtainium Ventures LLC, and their respective officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from:

  • Your use of the Site or our services
  • Your breach of these Terms
  • Your violation of any applicable law or regulation
  • Any inaccurate or misleading information provided by you

14. Termination

Either party may terminate a service engagement in accordance with the terms of the applicable SOW. In the absence of a specific termination clause in the SOW:

  • Either party may terminate with 30 days’ written notice
  • Reputation X may immediately terminate services if you breach these Terms or the SOW
  • Upon termination, all outstanding fees become immediately due and payable
  • Reputation X will deliver any completed work product through the date of termination

Reputation X reserves the right to refuse service to anyone at any time, for any reason, at our sole discretion.

15. Privacy

Your use of the Site is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Site, you consent to the practices described in our Privacy Policy.

16. Dispute Resolution

Any dispute arising out of or relating to these Terms or the services provided by Reputation X shall first be addressed through good-faith negotiation between the parties. If a resolution cannot be reached within 30 days, the dispute shall be resolved through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules.

Arbitration shall take place in Austin, Texas, unless otherwise agreed by the parties. The arbitrator’s decision shall be final and binding. Each party shall bear its own costs and attorneys’ fees, unless the arbitrator determines otherwise.

You agree that any claims shall be brought individually, not as part of a class action or representative proceeding.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.

19. Entire Agreement

These Terms, together with any applicable SOW and our Privacy Policy, constitute the entire agreement between you and Reputation X regarding the subject matter herein and supersede all prior agreements and understandings, whether written or oral.
